1、上海巿房屋租赁合同上海市房屋土地资源管理局上海市工商行政管理局制定二000年十一月印制While all terms and conditions shall be based on the Chinese version of Tenancy Agreement, this English version shall be for reference only. 上海房屋租赁合同SHANGHAI MUNICIPALITY TENANCY AGREEMENT(合同编号:)(Contract No. _)本合同双方当事人:Parties to Contract(出租)出租人(甲方): Lesso
2、r (Party A): 承租方(乙方): Lessee (Party B): 根据中华人民共和国合同法、上海市房屋租赁条例(以下简称:条例)的规定,甲、乙双方在平等、自愿、公平和诚实信用的基础上,经协商一致,就乙方承租甲方可依 出租 (出租)的 商品房 (房屋/商品房)事宜,订立本合同。In accordance with the Laws of Contract of the Peoples Republic of China and the Tenancy Regulations of the Shanghai Municipality (hereinafter referred to
3、as “the Provisions”), Party A and Party B, having reached an agreement based on the principles of equality, willingness and mutual benefit, hereby enter into this Contract on matters in relation to the Lease of the Property by Party A to Party B.一、出租房屋情况Condition of the Lease or Pre-Lease Property 1
4、-1甲方出租 (出租)给乙方的房屋座落在本市 区 (区/县) 路 路 弄/新村) (号/幢) 室(部位)(以下简称该房屋)。该房屋 实测 (【出租】实测)建筑面积为 平方米,房屋用途 住宅 ,房屋结构为 混合1。甲方已向乙方出示:Party A shall lease to Party B the Property situated at unit , No. , Lane , Rd( . District. (hereinafter referred to as “the Property”). The total gross area of the Lease Property shall
5、 be square meters, the purpose of the Land shall be for Consolidated Purpose , the type of Property shall be Residential Building , the structure shall be steel and cement .The floor plan of the Property see Appendix 1 of this Contract. Party A has already presented to Party B:1)【出租】房地产权证/房屋所有权证/ 房地
6、产权证 ;(证书编号: 沪房地 字 ( )第 号。LeaseCertificate of Ownership of the Property (Certificate No. ).1-2甲方作为该房屋的 房地产权利人 (房地产权利人/代管人/法律规定的其他权利人)与乙方建立租赁关系。签订本合同前,甲方已告知乙方该房屋 已 (已/未)设定抵押。Party A being the Owner of the Property and Party B have developed a lessor/lessee relationship. Before the signing of this Cont
7、ract, Party A has already informed Party B that the Property is subject to a mortgage.1-3该房屋的公用或合用部位的使用范围、条件和要求;现有装修、附属设施、设备状况和甲方同意乙方自行装修和增设附属设施的内容、标准及需约定的有关事宜,由甲、乙双方分别在本合同附件(二)、(三)中加以列明。甲、乙双方同意该附件作为甲方向乙方交付该房屋和本合同终止时乙方向甲方返还该房屋的验收依据。The area and the use of the public or common part of the Property; t
8、he existing fixtures, facilities, condition of equipment and the contents, standard and other relevant matters to be ascertained in relation to the fixtures and the facilities added by Party B with the consent of Party A shall be specified in Appendix 2, 3 of this Contract. Party A and Party B have
9、agreed the said Appendix shall represent the condition of the Property at the time of hand over of the Property by Party A to Party B and when Party B deliver up the Property to Party A at the expiry of this Contract.二、租赁用途Purpose of the Property2-1乙方向甲方承诺,租赁该房屋作为 住宅 使用,并遵守国家和本市有关房屋使用和物业管理的规定。Party
10、B warrants to Party A that the Property shall be used for Residential purpose and follows the regulations of the State and this Municipality in relation to the use and management of Property.2-2乙方保证,在租赁期内未征得甲方书面同意以及按规定须经有关部门审批核准前,不擅自改变上款约定的使用用途。Party B guarantee that during the lease term, it shall
11、not alter the purpose of the Property without Party As prior written consent as well as the approval from the relevant governmental department.三、交付日期和租赁期限Delivery Date and Lease Term3.1 租赁期为2 年,自2010年9月26日起至2012年9月25日止。自2011年9月26日至2011年9月25日该租赁为非固定期限,即在此期间乙方可以任何时候提前一个月通知甲方的前提下终止合同而不承担违约责任,即乙方最早可于201
12、1年8月27日提出退租,并于2011年9月26日正式退租。在乙方将全部因乙方租客实际使用而产生的水、电、燃气等杂费及电话费付清后的十个工作日内将全部剩余押金(如有,不计利息)退还给乙方。The above property is hereby leased for a term of two years, commencing on 26th Sep,2010 and expiring on 25th Sep,2012. The lease from 26th Sep,2011 to 25thSep,2012 is the free term, Party B can early termin
13、ate the contract by serving Party A one month prior notice without bearing any liability of the breach, that means Party B can earliest issue the termination notice to Party A on 27st Aug,2011 and then terminate the contract formally on 26th Sep,2011. Party A shall return Party B the rest of the sec
14、urity deposit (if has, without interest) within ten working days after Party B payoff all water, gas,electricity and telephone fees as tenant actual use.3-2租赁期满,甲方有权收回该房屋,乙方应如期返还。乙方需继续承租房屋的,则应于租赁期届满前 壹个月,向甲方提出续租书面要求,经甲方同意后重新签订租赁合同。Upon expiry of the lease term, Party A shall have the right to reposs
15、ess the Property in its entirety and Party B shall deliver it up accordingly. If Party B wishes to renew the lease, it shall submit such intent in writing to Party A One months prior to the expiry of the lease and sign a new lease contract with the consent of Party A.四、租金、支付方式和期限Rent, Method of Paym
16、ent and Term4-1甲、乙双方约定,【出租】月租金总计为人民币(RMB )(大写: 圆整 )。该房屋租金 壹 (年)内不变。Party A and Party B have agreed that.Lease The total monthly rent shall be RMB .The rent shall remain unchanged for one years. 4-2乙方应于每月 26 日前向甲方支付租金。逾期支付的,每逾期一日,则乙方需按日租金的0.5%支付违约金。Party B shall pay the rent by the 26 day of each mon

Late payment by Party B shall be subject to a penalty of 0.5% of the monthly rent per day.4-3乙方支付租金的方式如下:The rent shall be paid by Party B as follows:银行名称: Bank Name: 帐户名: Account Name: 帐号: Account No.: 五、保证金和其他费用Deposit and Other Fees and Charges5-1甲、乙双方约定,甲方交付该房屋时,乙方应向甲方支付房屋租赁保证金,保证金为 贰 个月的租金,
18、即(RMB )。甲方收取保证金后应向乙方开具收款凭证。租赁关系终止时,甲方收取的房屋租赁保证金除用以抵充合同约定由乙方承担的费用外,剩余部分无息归还乙方。Party A and Party B have agreed that at the time of the hand over of the Property by Party A, Party B shall pay to Party A a rental deposit of the Property, the deposit shall be TWO months of rent, that is RMB yuan. Party A
19、 shall issue a receipt to Party B after receiving payment of deposit.At the termination of the lessor/lessee relationship, the remaining deposit of the lease of the Property obtained by Party A shall be refunded to Party B after setting off the fees and expenses borne by Party B under the Contract w
20、ithout interest.5-2租赁期间,使用该房屋所发生的水、电、煤气、通讯费用由乙方(甲方/乙方)承担。其他物业管理费和发票的税费,会所使用费,卫星安装使用费及宽带安装费均由甲方(甲方/乙方)承担。During the lease term, the water, electricity, gas, communication of the Property and other fees resulted from the use of the Property shall be borne by Party B. All other management fee, club use
21、 fee ,satellite use and installation fee ,internet open fee, tax fee relevant expenses shall be borne by Party A.5-3乙方(甲方/乙方)承担的上述费用,计算或分摊办法、支付方式和时间:根据上述企事业单位列出的帐单凭证支付,如不按期付款,滞纳金由乙方承担。Party B shall be responsible to pay the above fees and charges, the computation or amortization, method and time of
22、payment: According to the demand notes, if delaying payment, Party B should be responsible for the penalty.六、房屋使用要求和维修责任Standard Required for Use of Property and Responsibility of Property Maintenance and Repair6-1租赁期间,乙方发现该房屋及其附属设施有损坏或故障时,应及时通知甲方修复;甲方应在接到乙方通知后的伍日内进行维修。逾期不维修的,乙方可代为维修,费用由甲方承担。During
23、the lease term, if Party B discovers any damages or defects of the Property and facilities attached, it shall notify Party A immediately for repair. Party A shall carry out the repair within 5 days after receiving notification from Party B. Any delay in repair may be repaired by Party B on Party As
