3、in accordance with the principles of voluntariness, equality and consultation. Both parties adhere to relevant provisions of the state and this municipality relevant laws and regulations. 一、聘用期限Employment Period第一条 期限为 年,自 年 月 日起至 年 月 日止。 1. If required by the work and with agreement by both parties, Party A can adjust Party Bs job title and
6、work location.三、工作时间和休息休假Working Hours And Vacations第六条 根据乙方工作岗位的实际情况,确定工作时间按以下第 种工时工种制执行。6. According to the actual situation of Party Bs job, option _ of the following would be chosen to be the working times schedule. (一)标准工时工作制:每日工作不超过八小时,且甲方应保证乙方每周至少休息一天。Standard working hours: Work no more than
7、 eight hours a day, and Party A shall ensure at least one off-day each week for Party B. (二)不定时工作制:甲方在保障乙方身体健康并充分听取乙方意见的基础上,应采用集中休息、轮休调休、弹性工作时间等适当方式,确保乙方的休息休假权利和生产工作任务完成。Non-fixed working hours: With consideration for Party Bs health condition and suggestions, Party A would adopt a proper way includ
8、ing concentrated rest, paid leave, flexible working hours to ensure Party Bs right on rest and vacations with completion of Party Bs work. Party A would withhold Party Bs due personal income tax and other legally charged fees from Party Bs salary.五、劳动保护、劳动条件和职业危害防护 Labor Protection, Working Conditions A
10、nd Occupational Hazard Protection第十条 甲方根据乙方岗位的实际情况,向乙方提供符合国家规定标准的劳动保护用品。10. According to the actual situation of Party Bs job requirement, Party A shall provide labor protection articles qualified for provisions of the state standard.第十一条 甲方为乙方提供符合国家安全卫生标准的工作场所和完成工作任务所必须的劳动工具。11. Party A should prov
11、ide work places qualified for national safety and health standards and tools necessary for the job.第十二条 甲方根据国家有关法律法规,建立健全安全生产制度和职业危害防护制度,双方应当严格遵守,严禁违章作业,防止事故的发生,减少职业危害。12. Party A shall establish safe production system and occupational hazards protection system according to relevant state laws and r
12、egulations. Both parties shall strictly abide by it to avoid illegal operation and prevent accidents which may cause occupational hazards.第十三条 乙方对甲方管理人员违章指挥、强令冒险作业,有权拒绝执行;对危害生命安全和身体健康的劳动条件,有权提出批评、检举和控告。13. Party B is entitled to decline any violated order or forcing of risk duties. Party B has the r
13、ight to criticize, impeach and charge to any labor conditions which may endanger his/her life safety and body health.六、劳动纪律Labor Discipline第十四条 遵守国家法律、法规及甲方指定的各项规章制度,遵守职业道德,维护甲方的荣誉和利益,按时保质保量地完成工作任务是乙方应尽的义务。14. Party B shall comply with national laws, regulations and rules pointed by Part A, abide by
14、 professional ethics, protect the honors and interests of Party A and ensure his/her completed staff work.第十五条 乙方应遵守甲方根据生产经营需要依法指定的规章制度和劳动纪律。如乙方违反甲方指定的规章制度和劳动纪律,甲方有权根据规章制度进行处理。15. Party B should abide by the specified rules, regulations and labor discipline specified by Party A according to the need
15、s of business operation. Party A has the right to proceed with rules and regulations if there are violations to the rules, regulations and labor discipline from Party B.第十六条 甲方的各类规章制度,及甲乙双方签订的有关协议均为本合同的有效补充,与本合同具有同等的法律效力。16. All rules and regulations, including agreements signed by Party A and Party
16、 B aside from this contract, have the equal legal effect as this contract.七、合同的履行、变更、解除、终止、续订Implement, Change, Remove, End and Renew Of The Contract第十七条 聘用合同期满前一个月,经双方协商同意,可以续订聘用合同。17. Agreed by both parties, Party A and Party B can sign a renew contract a month before the expiry date of the contra
17、ct.第十八条 下列情形之一本合同可终止18. Following situations may cause contract termination(一)本合同期满The contract expires(二)双方就解除本合同协商达成一致Both parties agree on termination of the contract(三)签订合同时的客观条件发生变化,无法继续履行合同The objective conditions changes and the contract cannot continue to perform (四)乙方由于健康原因不能继续履行本合同义务的Due t
