“工程” 是指实施委托人委托监理人监理工程。

“委托人”是指负担直接投资责任和委托监理人一方,和其正当继承人。

“监理人”是指受委托人委托负担监理业务和监理责任一方,和其正当继承人

“承包人”是指除监理人以外,委托人就本工程建设相关事宜签署协议当事人

“正常工作”是指双方在专用条件中约定监理工作范围

“附加工作”是指: 1)监理工作范围以外,经过双方书面协议另外增如本协议工作;2)建设工作范围增加或因为委托人或承包人原因致使进度延误,而造成附加工作

“额外工作”是指正常工作和附加工作以外，依据第三十三条要求监理人需要完成工作。

第二条 本建设工程委托监理协议适用法律是中国法律，条例,行政法规，和标准条件及专用条件中载明部门规章或地方法规，地方规章。

第四条 监理人应派出监理工作需要监理机构及监理人员，向委托人报送委派总监理工程师及其监理机构关键组员名单，监理计划，完成监理协议专用条件中约定监理工程范围内监理业务。在推行本协议义务期间，应按协议约定定时向委托人汇报监理工作。

第五条 监理人应认真，勤奋地工作，在推行协议义务时为委托人提供和其水平对应咨询意见，公正维护各方正当权益。

第六条 监理人使用委托人提供设施和物品属委托人财产，应合适使用和维护。在监理工作完成或中止时，应将其设施和剩下物品完好地移交给委托人。

第九条 委托人应该负责本工程建设全部外部关系协调（监理人所属协调关系除外）。依据需要，如需将 部分或全部协调工作委托监理人负担，则需在补充条款中明确委托工作和对应酬劳条款。

第十二条 委托人应该授权一名熟悉本工程情况，能在要求时间内作出决定委托人代表(将在专用条件中明确)负责和监理人联络，更换委托人代表要提前通知监理人。

第十三条 委托人应该将授予监理人监理权利，和监理人关键组员职能分工及监理权限立即书面通知已选定协议承包商，并在和任何第三方签署协议中给予明确。

第十四条 委托人应通知承包人在不影响监理人开展监理工作时间内向监理人提供如 下资料：

和将用于本工程原材料，构配件，机械设备等供给和生产厂家名目；

提供和本工程相关协作人，配合人名目。

第十五条 委托人应无偿（包含使用费）向监理人提供办公场所、通讯接口，网路接口住宿及协议专用条件约定其它设施。

第十六条 依据情况需要，如经双方同意委托人将能够自费向监理人提供其它人员， 应在协议专用条件中给予反应。

第十七条 监理人在委托工程范围内应含有以下权利，　而且在此双方确定任何以下活动也应作为监理人义务，即其有义务在有必需情况下为了以最好方法并以符合全部协议文件和适用法律方法完成本项目标目标而进行以下活动。

(1)选择工程总承包人提议权和义务；

(2)选择工程分包人提议权和义务；

(3)对工程建设相关事项包含工程规模、设计标准、计划设计、生产工艺设计和使用功效要求，向委托人提议权和义务；

(4)the right and bligatin t advise, in the priniples f safet and ptiu,the lient n the tehnial prbles in the design if the design is fund tbe nt in nfrit ith the qualit standards prulgated b the state rspeified in the design ntrat, the supervisr shall reprt t the lient inriting
(4)对工程设计中技术问题,根据安全和最优化标准,有权利和义务向委托人提出提议当发觉工程设计不符合国家颁布建设工程质量标准或设计协议约定质量标按时,监理人应该书面汇报委托人 并提供处理方案

(7)取得委托人同意,监理人有权公布开工令,停工令,复工令,但应该事先向委托人作出书面汇报委托人代表将能够随时电话联络到以就紧急情况和其它事宜和监理人进行研究

(8)工程上使用材料和施工质量检验权和义务发觉不合格材料应通知承包方，假如承包人在接到通知后仍继续使用该不合格材料, 监理人必需立即通知委托人, 让承包人不得继续使用 对于不符合设计要求和协议约定及国家质量标准材料,构配件,设备, 监理人有义务通知委托人让承包人停止使用;对于不符合规范和质量标准工序,分部分项工程和不安全施工作业, 监理人有义务立即通知委托人，监理人有权让承包人停工整改,返工 承包人只有经过委托人收到监理机构发出复工令后才能复工

(10)在工程施工协议约定工程价格范围内，工程款支付审核和签认权和义务，和工程结算复核确定权是否定权。未经总监理工程师签字确定，委托人不支付工程款。

第十九条　在委托工程范围内，当委托人和承包人对对方有任何意见和要求(包含索赔要求),双方争议由政府建设行政主管部门调解或仲裁机关（中国国际经济贸易仲裁委员会－上海[h1]）仲裁时，监理人应该提供相关证实。
