Signing of property management agreement 1、甲方使用区域为 ,租用面积为 平方米。(此面积与甲方签定的《商品房买卖合同》或《租赁协议》中所提及建筑面积为同一面积)。 1. The area used by Party A is , and the rentable area is m2. (This area is the same area as the floor area mentioned in “Contract on Sales and Purchase of Commodity House” or “Tenancy Agreement” signed with Party A.) 2、甲方应按照本协议,在与《租赁协议书》签约同时与乙方签订《XX大楼物业管理服务协议》,协议期限自 年 月 日起,至 年 月 日止。 2. Party shall sign “Agreement on property management service of XX Building” with Party B while signing “Tenancy Agreement” according to this agreement, and the term of this agreement shall start on (specify the date) and end on (specify the date). 二、物业服务费及其它费用 II. Property service charges and other expenses 1、甲方根据本协议规定,同意自本协议签订之日起向乙方缴纳物业服务费(此费用不包含用户自用电费、公摊水电费、电话费、网络费、空调使用费等在内),物业服务费收费标准为人民币 xx 元/平方米•月。 1. Party A agrees to pay property service charge to Party B from the date of signing of this agreement (this charge does not the expense of electricity consumed by the user himself, publicly shared water and electricity expenses, telephone charge, Internet charge, charge for use of air conditioner, etc.) according to the provisions of this agreement, and the charging standard is RMB xx Yuan/m2.month. 2、甲方应于本协议签订之日即日将物业服务费 陆 个月,计人民币(大写) ,人民币(小写) 元,一次性支付乙方,并按乙方的要求办理各项手续。 2. Party A shall pay at one time the property service charge for six (6) months of RMB Yuan (in words), RMB Yuan (in figures) to Party B on the date of signing of this agreement, and process various procedures according to Party B’s requirements. 3、物业服务费为每 个月支付一次,在协议有效期内,甲方须于收到乙方书面通知后7日内将物业服务费交到乙方或指定银行帐号。 3. The property service charge shall be paid every months, and within the validity of this agreement, Party A shall hand the property service charge to Party B or the designated bank account within seven (7) days after receipt of Party B’s written notice. 4、其它费用: 4. Other expenses: 甲方除须缴纳物业服务费外,还须承担下列费用: Besides the payment of property service charge, Party A shall undertake the following expenses: (1)自用电费(物业服务中心代收); (1) Charge for self-consumed electricity (to be collected by the property service center); (2)电话初装费及使用费(自行缴纳); (2) Initial installation charge and use charge of telephone (to be paid by itself); (3)网络初装费及使用费(自行缴纳); (3) Initial installation charge and use charge of Internet (to be paid by itself); (4)空调使用费(物业服务中心代收); (4) Charge for use of air conditioner (to be collected by the property service center); (5)公摊水、电费(实际发生进行分摊); (5) Publicly shared water and electricity charges (to be allocated according to the figures actually taking place); (6)其它国家法律法规规定应由甲方缴纳费用。 (6) Other expenses that shall be paid by Party A according to the stipulations of the state laws and statutory regulations. 三、甲方的权利和义务 III. Rights and Obligations of Party A 1、甲方有权根据本协议及乙方制定的一切有关该物业的规章制度的规定,使用该物业协议区域及按规定使用公共区域及公共设备。 1. Party A shall have the right to use the area set out in this property agreement and use the public area and public facility as specified according to this agreement and all the provisions of regulations and rules worked out by Party B on this property. 2、甲方有权监督乙方各项管理规章的实施。 2. Party A shall have the right to supervise implementation of various management regulations by Party B. 3、甲方有权向乙方投诉管理服务方面问题。 3. Party A shall have the right to file a complaint to Party B about the problems in the aspect of management service. 4、甲方有义务服从乙方的管理,同时甲方须保证其雇员、访客及其受甲方许可进入大厦内的人员在使用、管理、维护该物业过程中遵守本协议及大厦的相关规定。甲方的雇员、访客及其受甲方许可进入大厦内的人员在使用、管理、维护该物业过程中的失责行为、违约行为、侵害行为,均视作甲方自身的行为,并由甲方承担相应的责任和费用。 4. Party A shall have the obligation to obey Party B’s management, meanwhile Party A must guarantee its employees, visitors and personnel allowed by Party A to enter the building to comply with the provisions of this agreement and relevant regulations of the building in the process of use, management and maintenance of this property. Default, breach and infringement actions of Party A’s employees, visitors and personnel allowed by Party A to enter the building in the process of use, management and maintenance of this property shall be considered as Party A’s own actions and Party A shall bear corresponding liability and cost. 5、甲方置于该物业内财产的相关保险事宜由甲方自行解决或委托乙方协助办理,费用由甲方承担。 5. The insurance which Party A effects on the properties within this property shall be settled by itself or commissioned to Party B to assist in handling, and the expense shall be borne by Party A. 6、甲方同意乙方(或乙方授权的代理人)在合理的时间内,经事先通知(或在紧急情况下,未经事先通知)进入该物业巡视,检查该物业内部各部分状态或处理紧急事项。需由甲方负责进行的维修,甲方应根据乙方(或乙方授权的代理人)的要求立即自行出资予以维修;否则乙方(或乙方授权的代理人)有权代为维修,所需费用由甲方承担。需由乙方负责进行的维修,乙方应立即派人进行维修。 6. Party A agrees Party B (or the agent authorized by Party B) to enter and make rounds within this property subject to prior notice (or without prior notice in emergency situation) in order to check the condition of each part within this property or handle emergency situation. For the repair for which Party A is responsible, Party A shall immediately make repair at its own cost according to the requirements of Party B (or the agent authorized by Party B); otherwise Party B (or the agent authorized by Party B) shall have the right to make such repair at the cost of Party A. For the repair for which Party B is responsible, Party B shall immediately arrange personnel to make repair. 7、甲方进驻大厦后,不得私自改变建筑原貌,未经乙方允许不得在楼外及楼内公共空间、墙面张贴设置广告、标牌等,不得影响建筑物内外景观,不得以任何形式占用楼内公共空间。 7. After Party A enters the building, it shall not change the original appearance of the building without authorization and shall post or set up advertisement, sign board, etc. outside and inside the public space and on walls of the building without permission of Party B, which shall not affect the internal and external landscape of the building and shall not occupy the public space inside the building in any form. 8、因甲方对该物业使用、管理、维护不当等原因而致他人财产或人身受到损害时,甲方应自行解决由此而引发的纠纷,并自行承担由此而导致的损失及后果。 8. In case of damage to properties of others or personal damage due to Party A’s improper use, management, maintenance, etc. of this property, Party A shall settle the dispute arising out thereof by itself and undertake the loss and consequence arising out therefrom by itself. 9、甲方不得在大厦内进行非法活动,不得进行任何妨碍或侵扰其他用户的活动。如有上述行为,乙方有权终止与其的一切协议。 9. Party A shall not conduct any illegal activities inside the building and shall not conduct any activities which hinder or disturb other users. If there is any above behavior, Party B shall have the right to terminate all the agreements with it. 10、甲方有义务保持楼内整洁,不得在公共区域内堆放货物或杂物。如发生上述情况,经乙方书面警告2小时内不予清理,乙方有权予以制止、清理,并向甲方征收清除费。如造成损失,由甲方全权负责。In case of any loss, Party A shall be bear all the liabilities. 如甲方因特殊情况,需临时占用公共空间,甲方须提前向乙方提出申请,得到乙方批准后,按乙方批准的物品存放地点和存放期限统一存放。 10. Party A shall have the obligation to keep tidy within the building and shall not pile up goods or sundries in the public area. In case any of above cases occurs and is not eliminated within 2 hours subject to written warning of Party B, Party B shall have the right to stop and eliminate it and charge Party A for elimination fee. In case Party A needs to occupy the public space temporarily due to special situation, it must submit an application to Party B beforehand, and store its goods in a unified way according to the storage area and storage period approved by Party B after Party B approves the application. 11、甲方不得在楼内存放任何易燃易爆、剧毒等危险品,以及进行任何危害楼宇和人员人身安全,或引致投购保险失效或使保险费增加的活动。 11. Party A shall not store any dangerous products such as inflammable, explosive and extremely toxic substances, etc. inside the building and conduct any activities which endanger the safety of the building and personnel, or cause to invalidate the insurance covered or increase insurance premium. 12、未经乙方批准,甲方不得擅自更改、迁移或增大用电水装置。用电量超过大厦提供的基本电量,甲方应交纳超出部分的电贴费及相应的工程改造费用。 12. Without approval of Party B, Party A shall not modify, relocate or increase the capacity of water and/or electricity consuming device. In case electricity consumption exceeds the basic electric consumption provided by the building, Party A shall pay the electric subsidy fee of the exceeded part and corresponding engineering retrofitting fee. 13、甲方须服从大厦广场管理人员的管理,按规定存放泊停车辆。违反规定者,乙方工作人员有权以纠正和制止。 13. Party A shall obey the management of the building’s square management personnel and park its vehicle as stipulated. In case of any breach, Party B’s workers shall have the right to rectify an stop it. 14、甲方有义务爱护大厦内外的一切设备设施,因甲方的责任造成的损失和由此引发的一切费用由甲方承担。 14. Party A has the obligation to take care of all the equipment and facilities inside and outside the building, and shall undertake any loss on its account and any and all the costs incurred thereby. 15、甲方入住时对房屋有装修要求,应提前5日向乙方提出书面申请并同时报送装修方案,经乙方同意后方可进行装修。进场装修的施工队伍应具备合格资质条件,经乙方同意后方可入场施工,并接受乙方的监督检查。 15. In case Party A requires to decorate the house upon residence, it shall submit written application to Party B five days ahead of the application and submit its decoration scheme at the same time, then it can carry out decoration after consent of Party B. The construction team entering the site for decoration shall have acceptable qualification conditions, shall not enter the site for construction until Party B approves and shall accept Party B’s supervision and inspection. 16、由于甲方系统设备出现故障而对甲方设备财产造成的损坏或损失,由甲方自行保险承担。乙方不予负责。 16. For any damage or loss caused to Party A’s equipment and property due to failure of Party A’s system and equipment, Party A shall effect insurance for them and undertake them by itself. Party B shall not bear any liability. 四、乙方的权利和义务 IV. Rights and Obligations of Party B 1、乙方有权对大厦进行有效的管理,制定管理规章和有偿服务的收费标准、违约处理标准,建立健全财务管理制度,并根据日常管理运行,建立一套完整的工作程序,并在实践中不断完善。 1. Party B shall have the right to exercise effective management of the building, develop management regulations and charging standards for paid service as well as standards for treatment of breaches, establish and perfect financial management system, and establish a set of complete working procedures according to its daily management an continuously perfect them in its practice. 2、乙方有权检查、巡视大厦公共区域及共用设施设备。乙方(或乙方授权的代理人)在合理的时间内,经事先通知(或在紧急情况)可以进入该区域巡视,检查该房内部各部分状态或采取各种措施处理紧急事项,甲方不得以任何理由进行阻挡。 2. Party B shall have the right to inspect and make its rounds to the public area and public facilities and equipment. Party B (or its authorized agent) may enter the said area to make its rounds subject to prior notice (or in emergency situation) within reasonable time to inspect the condition of each part inside the house or take various measures to deal with emergency situation, and Party A shall not stop Party B from doing so for any reason whatsoever. 3、如果甲方未征得乙方的允许私自装修,或装修时违反装修规定,要求甲方将装修物业恢复原貌,由此发生的修复费以及对乙方造成的损失费全部由甲方承担。情节严重或拒不服从管理者,乙方有权终止与其签订的一切合同,甲方装修期间,乙方有权进入装修物业,检查装修是否按规定正常进行。 3. In case Party A carries out decoration privately without permission of Party B or violates decoration regulations during the decoration, Party A is required to reinstate the appearance of the decorate property, and shall undertake the rehabilitation expense incurred thereby and all losses incurred to Party B. In serious case or in case Party A refuses to obey the manager, Party B shall have the right to terminate all the contracts signed with it, during the decoration of Party A, Party B shall have the right to enter the property under decoration to check if the decoration is carried out normally according to the regulations. 4、乙方负责大厦内部公共区域和外部周边环境的清洁卫生。 4. Party B shall be responsible for the cleaning and hygiene of the public areas inside the building and its surroundings. 5、乙方负责协助政府职能部门做好大厦的安全、公共秩序维护、消防等工作,定期组织有关方面的宣传教育,做到发现问题及时处理。 5. Party B shall be responsible for assisting governmental functions to well do such works as of safety, maintenance of public order, fire protection, etc. of the building, regularly organize relevant publicity and education in order to handle any problem in time once it is found. 6、乙方负责大厦公共设备设施的维护、保养工作。其中所有高档仪器设备由专人负责,制定标准的操作程序,对有关人员定期培训。非由大厦或物业管理公司提供的设备设施,乙方不负责其维护、维修。 6. Party B shall be responsible for maintenance work of public equipment and facilities inside the building. For all high-grade apparatus and equipment, Party B shall specially assign personnel to be responsible for maintenance of them, work out the standard operation procedures and carry out periodic training on relevant personnel. Party B shall not be responsible for maintenance and repair of the equipment and facilities not provided by the building or property management company. 7、乙方有权清除、拆除任何不符合管理规定的建筑物、安装物以及公共区域摆放的货物或杂物,并向有关单位或人员征收清除费或违约金。 7. Party B shall have the right to remove or dismantle any building and installation not complying with the management regulations and goods or sundries laid in public area, and charge removal fee or liquidated damages to relevant unit or person. 8、乙方负责控制和安排大厦广场内所有车辆的停放,并有权拖离所有违反规定停放车辆。 8. Party B shall be responsible for controlling and arranging the parking of all the vehicles inside the building square, and have the right to tow off all the vehicles parked in violation of the regulations. 9、发生紧急情况和突发事件时,乙方有责任采取应急措施,保障楼内人员生命财产安全,最大限度减少各方面的损失。 9. In case of emergency situation and sudden event, Party B shall have the right to take emergency measures to safeguard the safety of the people and properties inside the building in order to minimize the loss in every aspect. 10、乙方应认真对待客户投诉,凡属管理责任问题要及时解决,并将解决结果通知客户;凡近期无法解决的,乙方负责向甲方解释。 10. Party B shall carefully treat customer complaints, where the complaint belongs to the problem of management responsibility and needs to be settled in time, Party B shall notify the result of the solution to the customer; where the complaint cannot be solved in short term, Party B shall be responsible for explanation to Party A. 11、乙方应做好各项配套服务。 11. Party B shall well do various supporting services. 12、乙方须接受甲方的监督检查。 12. Party B must receive supervision and inspection of Party A. 五、违约责任 V. Liability for breach of agreement 1、双方均应遵守本协议的各项规定,任何一方违反本协议的规定,应承担违约责任;给对方造成经济损失的,还应赔偿损失费。 1. Both parties shall observe various provisions of this agreement, any party in breach of any provision of this agreement shall bear the liability for breach; in case Party B cause the other party to suffer economic loss, it shall compensate Party A- 配套讲稿:
