Unless otherwise regulated by law, all the contracts shall be fixed-term contracts. The period of contract is normally 3 years, or other periods agreed between the company and the employees. 劳动合同到期时,经公司和员工协商一致,可续签合同。 When labor contracts expires, it may be renewed after the company and employees reach an agreement through negotiation. 任何首次受雇于公司的员工都应在其劳动合同期限开始之日起的不超过3个月期间为试用期(直接工人试用期可为2个月)。试用期结束后,除非公司认为员工不符合录用条件,员工将继续为公司工作。 Any employee employed by the company shall have a probation period no more than 3 months after the beginning date of his/her labor contract.(Direct labor probation period can be 2 months), After the probation period expires, unless the company believes that the employee doesn’t meet the recruitment condition, the employee will continue to work for the company. 公司在试用期内或结束之时可对员工的工作表现进行评估。员工不符合录用条件的情况包括但不限于: During or after the probation period, the company may evaluate the work performance of employees. The circumstances that employees don’t meet recruitment conditions include but not limited to: Ø 员工提供或要求第三方为其提供虚假的个人信息或文件或与雇佣有关其他信息或文件。 Employees provide or require any third party to provide false personal information or document or other information or document relating to employment. Ø 员工未能通过公司所指定的医院的健康体检。 Employees fail to pass the health examination at the hospital designated by the company. Ø 员工对其前雇主负有未了结的债务,且公司认为该等债务可能会对员工在公司的工作带来不利的影响。 Employees have unsettled debt with former employer, and the company believes that such debt will bring negative influence to the employees’ work in the company. Ø 员工对其前雇主负有竞业限制义务。 Employees have competitive restriction obligation to their former employers. Ø 员工不能胜任公司的工作任务。 Employees are not capable of work tasks in the company. Ø 员工未能通过公司的工作表现评估。 Employees fail to pass the work performance assessment in the company. Ø 员工的身体条件不符合其工作岗位的岗位要求(例如特殊岗位的要求)。 Employees’ physical conditions don’t meet the position requirements of their work positions (such as requirements for special positions). 4.4 培训、升职和调动Training, promotion and transfer 根据员工的能力和工作表现,公司将自行决定向适合的员工提供平等的培训及升职机会。公司有权要求接受公司出资的专项或专业技术培训的员工与公司签订一份服务期协议。 Based on the ability and work performance of employees, the company will decide at its discretion to provide proper employees with the equal training and promoting opportunities. The company will be entitled to signing a service period agreement with the employees accepting the specific or professional training paid by the company. 根据业务需要,公司可将员工调往XX的其他岗位或其他关联公司工作。 Based on business demand, the company may transfer employees to other positions or other affiliated companies of Lightning. 如果员工希望调动工作,应向其直接主管提出书面申请,直接主管将协同人力资源部共同考虑员工的申请。如果公司认为员工所申请的调动不具有可行性,则该等申请将不会被批准,其直接主管或人力资源部应尽量在合理的时间内将此结果告知员工。 If employees wish to transfer work, they shall submit written application to their direct director, who will assist the human resource department in considering the employees' applications. If the company believes that the transfer applied by employees are is not feasible, then such applications won’t be approved, their direct directors or human resource department shall inform such employees about the result in reasonably short period. 4.5 劳动关系的终止和解除 Termination and cancellation of labor relation 4.5.1 有下列情形之一的,在中国法律允许的情况下,公司可立即单方解除劳动合同: For any of the following circumstances, the company may unilaterally cancel the labor contract allowed by Chinese law: Ø 员工在试用期内被证明不符合录用条件(包括但不限于本手册第4.3部分所列的条件); Employees are proven to be not meeting the recruitment conditions during probation period (including but not limited to the conditions listed in article 4.3 of this manual); Ø 员工严重违反了公司的规章制度(包括但不限于本手册)。该等行为的实例如下所列,但下述实例并非意在穷尽所有的可能: Employees have seriously violated the company’s regulations and systems (including but not limited to this manual). Such behaviors have examples are listed as followed, but which examples are not exhausting all the possibilities: n 偷窃公司或其他员工的产品、财物(如金钱、产品、原材料、工具等); Steel product, property (such as money, product, raw material, tool, etc) of the company or other employees; n 欺诈行为,包括但不限于: Fraudulent conduct, including but not limited to: u 欺骗公司和/或同事,伪造文件或记录(如申请病假的医院证明,身份证、学历及专业资格证明及其他个人信息); Cheat on the company and/or colleagues by forging documents or records (such as hospital certificate for applying sick leave, ID certificate, diploma, professional qualification certificate and other individual information); u 贪污公司财物(如利用假发票); Embezzling of company property (such as using fake invoice); u 伪造数据、报表或材料(如假销售纪录、假签名等);或 Forge data, statement or material (such as false sales record, false signat- 配套讲稿:
