Training Agreement
培训协议

This Agreement is entered into on _____________ xxx,
本协议于xxx年___月___日订立，签约各方如下：

Between

[ xxx children training school of education [linfen], the People’s Republic of China,
[xxx儿童教育培训学校] 下称“[xxx学校]” ，地址为中国[临汾]；

And /和

[ ] (ID No.: [ ] (hereinafter “Staff”).
[ ]（身份证号码：[ ]（下称“员工”）签署。

Whereas:
鉴于：

1) The Staff is being employed by the center according to employment agreement signed on [ ] (hereinafter “Employment Agreement”).
根据[ ]签署的劳动合同（下称“劳动合同”），员工受聘于中心。

2) The center intends to dispatch the Staff to [ ] (hereinafter “Training Center”) for the technical training.
中心拟派遣该员工到[ ]（下称“培训中心”）接受技术培训。

Now, therefore, in consideration of the conditions set forth in this Agreement, the Parties mutually agree as follows:
据此，基于本协议所述之条件，各方协议如下：

Article 1 The training period shall be ( ) week subject to the availability of the relevant approvals. The center shall have the right to adjust and/or to change the training period or cancel the training according to its sole discretion。
培训期限为( )周，但以经审批的相关许可为准。中心有权自行选择调整和/或变更培训期间、或取消培训。

Article 2 During the training, the staff shall:
在培训期间，该员工应：

1. comply with the daily schedules and complete training to carry out the tasks assigned.
服从日程安排并完成培训以执行指派任务。

2. follow the operational, safety and security regulations and directions.
遵循操作、安全规章和指示。

3. treat the work equipment with care and only use the work equipment for the assigned tasks, which shall be given back in a good state.
爱护工作设备，仅为指派任务之目的使用工作设备，使用后将其完好归还。

4. keep confidential the technical and business information and information received during the training period and will not reveal or divulge the same to third parties, or use or publish it in any manner, without prior written approval from the center or Tamuz.
对技术和商业信息及培训期间收到的信息保密，未经中心或培训中心事先书面同意，不得向第三人透露或泄露保密信息、或以任何方式使用或公开该项信息。

Article 3 The center shall be responsible for the expenses involved in the training (hereinafter “Training Expenses”). They are estimated to be as follows:
中心承担培训费用及住宿费用的开支（下称“培训开支”）。开支预计如下：

1. training fee [ ] CNY days;
培训费：[ ] CNY 天；

2. accommodation costs [ ] days;
住宿费：[ ] 天；
3. Meal costs{ } 每天
食宿费：｛ ｝每天

The expenses, except the training fee, booked and certified by the center shall be final and binding between the Parties.
上述开支，除培训费外，一经中心入账和确认，即为最终费用，对各方均具有约力。

Article 4 The Staff agrees that he shall serve the center for 24 months after returning from the training (hereinafter “Service Period”).
该员工同意，自培训后返回中心之日起，其应为公司服务24个月（下称“服务期”）。

Article 5 If for any reason the Staff fails to work for the center, the Staff shall compensate the center according to the schedule below:
如该员工因任何原因，未能如约为中心工作，应按下表赔偿公司：

50% of the Training Expenses

Service period of more than 18 months but less than 24 months

25% of the Training Expenses
赔偿25%的培训开支

Article 6 All disputes arising under this Agreement or in connection with the transaction hereunder shall be resolved between the parties in good faith. However, if these efforts fail, the dispute shall be resolved in accordance with the laws of the People's Republic of China. The competent courts of the People's Republic of China shall have sole and exclusive jurisdiction over any issue arising out of or in connection with this Agreement.

凡因本协议引起的或与本协议项这交易有关的任何争议，各方应本着诚信加以解决。但，如经努力仍未达成一致，争议应根据中华人民共和国法律解决。因本协议产生的或与之有关的任何争议事项，中华人民共和国有管辖权的法院具有唯一的、排他性的管辖权。
